Mr. Meyer has consulted to clients on financial, accounting, economic and damages matters for 30 years and has evaluated and quantified hundreds of economic damages claims. Many of these matters have involved breach of contract issues and damages. He has provided expertise and analysis on valuation and licensing matters in a wide range of industries including numerous high technology assignments. His extensive intellectual property experience includes analyzing financial and economic damages related to alleged infringement and misappropriation of patents, trademarks, copyrights and trade secrets. Mr. Meyer has consulted on many products across a variety of different industries, including computer hardware and software, file and data systems, integrated circuits, consumer goods, flash memory, smartphones, eye care, pharmaceuticals, medical devices, cosmetics, apparel, office products, plastic bottling, personal hygiene, frozen foods, dental technology, spinal implants, utility partitioning software, e-commerce networking technology, telecommunications equipment, satellite television, web-conferencing, light emitting diodes (LEDS), liquid crystal displays, optical networking, telephonic billing systems, biotechnology, computer maintenance and servicing, hospitality, cellular communications, energy, aircraft, flash memory, consumer credit scores, disc drives, CD-ROM controllers, flash memory, SLICs, ASICs, MOSFETS, IGBTs, nutritional supplements, software, video games, resettable fuses, knee braces, professional sports merchandise, laser measuring devices, sporting goods, VCR’s, architectural plans, risk microprocessors, toys and games, and automotive diagnostic equipment, as examples.
Mr. Meyer has testified in over 200 depositions and approximately 70 trials and major arbitrations, including 35 jury trials. His testimony has included federal and state court, the London Court of International Arbitration and the International Trade Commission. Mr. Meyer provided expert testimony at trial on damages in two of the largest copyright infringement matters in history.
On behalf of the Defendant, MGA Entertainment, Mr. Meyer provided rebuttal testimony to a $1.8 billion damages claim made by Mattel in a copyright infringement matter involving the “Bratz” fashion dolls. After a lengthy trial, the jury awarded $10 million in copyright damages, and $30 million for each of three separate claims. In an unrelated matter, Mr. Meyer testified to Plaintiff Oracle's damages in a copyright infringement dispute against SAP involving enterprise software. The jury returned a verdict of $1.3 billion, which was reported by Bloomberg as the largest jury verdict of 2010 and the largest copyright infringement verdict ever.
Mr. Meyer is also experienced in disputes and investigations involving forensic analyses related to determining the propriety of accounting activity, asset disposition and valuation and sources and uses of funds flow. This experience includes the investigation of ponzi schemes, fraudulent invoice schemes, and separate entity analyses.
Mr. Meyer lectures on damages and other issues to industry and academic audiences such as the Licensing Executives Society, the Practicing Law Institute, Law Seminars International, the USC Intellectual Property Institute, Santa Clara University Law School, Stanford Law School and the Sedona Patent Conference.
